Agreement Between the User and NZIIP. 
The Institute website is comprised of various Web pages operated by the New Zealand Institute of Intelligence Professionals (NZIIP). The NZIIP website is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the NZIIP Website constitutes your agreement to all such terms, conditions, and notices.

Modifications of these Terms of Use. 
The Institute reserves the right to change the terms, conditions, and notices under which the NZIIP website is offered, including but not limited to the charges associated with the use of the NZIIP website.

Links to Third Part Websites. 
The NZIIP website may contain links to other websites (‘Linked Sites’). The Linked Sites are not under the control of NZIIP and NZIIP is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. NZIIP is not responsible for webcasting or any other form of transmission received from any Linked Site. NZIIP is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by NZIIP of the site or any association with its operators.

No Unlawful or Prohibited Use. 
As a condition of your use of the NZIIP website, you warrant to the NZIIP that you will not use the NZIIP website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the NZIIP website in any manner which could damage, disable, overburden, or impair the NZIIP website or interfere with any other party’s use and enjoyment of the NZIIP website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the NZIIP website.

Copyright and Trademark Notices. 

All contents of the NZIIP website are copyright by the NZIIP and/or its suppliers. All rights are reserved. The names of actual companies and products mentioned herein may be the trademarks of their respective owners. No association with any real company, organisation, product, person, or event is intended or should be inferred. Any rights not expressly granted herein are reserved.

Dispute Resolution 
If a dispute arises between the NZIIP and any other party and that dispute is covered by our Rules, the dispute shall be resolved according to those Rules.

If a dispute arises which is not specifically covered by our Rules the Parties shall attempt to resolve the dispute using the dispute resolution process set out below:

Either Party can initiate the dispute resolution process by giving written notice to the other Party (“the Dispute Notice”);

The Parties must attempt to resolve the matter by negotiation in good faith;

If, after a period of not less than 15 Business Days following the Dispute Notice, the Parties cannot resolve the matter by negotiation, either Party can advise the other Party in writing that they wish to resolve the matter by mediation (“Mediation Notice”).

Where Mediation Notice is given, the NZIIP Chairperson shall appoint an independent mediator.

If the dispute cannot be resolved within 15 Business Days of the appointment of the independent mediator, or such other period as agreed to in writing between the Parties, either Party can submit the dispute to arbitration in accordance with the provisions of the Arbitration Act 1996.

The cost of mediation and/or arbitration under this clause, if any, shall be shared equally between the Parties.

This clause does limit or affect in any way:

  • (a) any right, power or discretion of NZIIP, including those specified in the NZIIP Rules, including, but not limited to, NZIIP’s right to terminate membership at any time according to the Rules; or
  • (b) NZIIP’s right to apply to a court for any interim or preliminary relief in respect of a dispute.

Refunds
Refund of any monies paid to the NZIIP shall be dealt with in accordance with our Rules or where the situation is not covered by those Rules, as follows:

Membership joining/application and subscription fees:
The NZIIP joining/application fee plus the relevant subscription fee for the first year are payable at the time of application for membership. If an application for membership is not accepted by the NZIIP any annual subscription fees paid will be reimbursed to the applicant at the time that application is declined.

Other Payments
From time to time the NZIIP holds events that will require payment to attend. In cases where the NZIIP requires registration and payment prior to the event any refunds, if required, will be available on the following basis unless otherwise specified in the notification for that particular event:

  • Full refund if notification of withdrawal of registration reaches the Secretary at least 14 days prior to the event.
  • 50% refund if notification of withdrawal of registration reaches the Secretary 7 or more days, but less than 14 days, prior to the event.
  • No refund shall be given if notification of withdrawal of registration is received less than 7 days before the event or if the member does not attend that event.
